Terms and Conditions

1. AGREEMENT TO TERMS
These Terms of Use are a legally binding agreement between you, whether personally or on behalf of an entity (you), and athme ApS (we, us, our). They govern your access to and use of the athme mobile application and related websites, services, and channels (the App). We are registered in Denmark at Porcelænshaven 26, 2, 2000 Frederiksberg. Contact: +45 9399 3798.
By accessing or using the App you confirm that you have read, understood, and agree to these Terms of Use. If you do not agree, do not use the App.
We may update these Terms at any time. We will update the Last updated date and may notify you in the App. Your continued use after an update means you accept the new Terms.
The App is not intended for use where such use would be contrary to law or would require local registration. If you access from another location, you are responsible for compliance with local laws.
The App is intended for users who are at least 18 years old.
2. WHO WE ARE AND OUR ROLE
athme operates a sports platform and community. Through the App, users can discover, book, and participate in sports events and activities. athme organizes and sells all Events in its own name and is the merchant of record for every in-App transaction. We collect participant payments via Stripe and we handle refunds and disputes as described in these Terms.
Some Events may be facilitated by community hosts who help coordinate or run the activity on the day. These hosts are not sellers and are not parties to your contract. They receive non-cash perks such as free participations and in-App coins for completing hosting quests. They do not receive your payments.
3. KEY DEFINITIONS
• Event means a dated sports activity or service shown in the App.
• Host means a community member who facilitates an Event on behalf of athme under our guidelines. Hosts are not sellers and do not receive cash consideration from you.
• Participant means a user who books or attends an Event.
• Partners means third parties that provide offers in the App.
• athme coins means in-App credits issued by athme. Coins are not money, not electronic money, and not a gift card. Coins are non transferable, cannot be redeemed for cash, and can be used only for eligible benefits in the App as described in section 12.
4. ACCOUNT AND ELIGIBILITY
You must create an account to use certain features. Keep your credentials confidential. You are responsible for all activity under your account. We may refuse, reclaim, or change a username that we deem inappropriate. Information you provide must be true, accurate, current, and complete, and you must keep it updated.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the App (or any portion thereof).
5. BOOKING AND CONTRACT FORMATION
Your booking is confirmed when you receive the confirmation screen or email. The contract for the Event is between you and athme. Event pages show time, location, price, capacity, and any specific rules. Tickets are personal unless the Event description allows transfer.
6. PRICES, FEES, AND TAXES
Prices are shown in DKK and include VAT where applicable unless stated otherwise. We may charge a participant service fee which is shown before payment. We may issue a Danish invoice or receipt electronically.
7. PAYMENTS WITH STRIPE
7.1 Processor and acceptance
All in-App payments are processed by Stripe Payments Europe, Limited and its affiliates. By paying in the App you agree to the Stripe Services Agreement that applies to your payment method. athme does not provide regulated payment services and does not hold customer funds as a payment institution.
7.2 Merchant of record
athme is the merchant of record for every transaction made in the App. Your card or wallet statement will show a reference to athme or a Stripe descriptor used for athme.
7.3 Payment methods and currency
We accept cards, Apple Pay, Google Pay, and MobilePay, subject to availability in your country or device. Prices are displayed and charged in DKK. We accept cross-border cards. Your provider may apply currency conversion or fees if your account is not in DKK.
7.4 Authorization and capture
We capture payments immediately at booking unless the Event page states otherwise. If a transaction fails, your booking may be cancelled.
7.5 Strong Customer Authentication
You may be asked to complete Strong Customer Authentication such as 3D Secure. If authentication fails, your booking may not complete.
7.6 Stored credentials and subscriptions
We do not store cards for future use and we do not offer subscriptions or recurring payments at this time.
7.7 Refunds and processing times
Refunds are returned to the original payment method. Processing times depend on your provider and are outside our control.
7.8 Fraud screening and security
Stripe provides fraud screening. We do not use custom Stripe Radar rules at this time. We may decline or cancel a payment, require additional verification, or block an account if we suspect fraud, unauthorized use, or legal risk.
7.9 Disputes and chargebacks
athme handles chargeback responses and evidence. If a dispute is decided against us, we may retain or recover the disputed amount, dispute fees, and any related fines as allowed by law.
8. CONSUMER RIGHTS, CANCELLATIONS, AND REFUNDS
8.1 Withdrawal right for dated Events
Under EU law, there is no statutory withdrawal right for services related to leisure activities if the contract provides for a specific date or period. Most Events fall within this exception.
8.2 Your cancellation
You may cancel an Event booking up to 24 hours before the scheduled start time for a refund according to the Event policy. If coins were used, we restore coins rather than cash. To request a refund, email the address listed in the App or on our website and include your booking reference.
8.3 Reschedules and partial refunds
You may request a reschedule or a partial refund more than 24 hours before the start time. Approval depends on availability and the Event policy.
8.4 Less than 24 hours
Cancellations within 24 hours of the start time are not refundable unless the Event page expressly allows it.
8.5 No-shows and late arrivals
If you do not attend or arrive too late to participate, you are charged the Event fee and an additional no-show fee equal to the Event fee. If the additional fee is not paid on request, your account may be blocked until full payment is made. If you used coins for the original booking, we may withdraw or not restore coins in line with the Event policy.
8.6 Cancellation by athme
If an Event is cancelled or materially changed by us, you will receive a refund of the amount you paid for the cancelled part. If coins were used, we restore coins rather than cash.
8.7 Force majeure
If an Event cannot proceed due to circumstances beyond reasonable control, it may be rebooked or refunded according to the Event policy.
9. SAFETY, CONDUCT, AND VENUE RULES
You are responsible for your own health and fitness to participate. Follow venue rules, host guidance, and applicable laws. We may remove or ban users who engage in unsafe, abusive, or illegal behavior. You are responsible for any damage you cause to venues or equipment.
10. COMMUNITY HOSTS AND HOSTING QUESTS
Hosts are community members who facilitate Events under athme guidelines. Hosts are not sellers and are not parties to your contract. They do not collect payments from you. Hosts may receive non-cash perks such as free participations and athme coins for completing hosting quests. Hosting does not create an employment relationship with athme. Hosts must follow our Host guidelines and code of conduct. We may suspend hosting privileges at any time to protect users and the quality of Events.
11. REVIEWS AND USER CONTENT
If the App allows reviews or other content, post only factual, firsthand experiences. Do not post unlawful, offensive, or discriminatory content. We may moderate, remove, or reorder reviews and may take steps to verify that reviews originate from users who attended an Event.
12. IN-APP CURRENCY: ATHME COINS
Nature of coins
athme coins are in-App credits. Coins are not legal tender, not electronic money, not a stored value product, and not a gift card. Coins cannot be exchanged for cash and cannot be transferred between users. We may grant coins through quests, referrals, promotions, or other activities. Where offered, coins may also be purchased in the App.Use of coins
Coins can be redeemed only for eligible in-App benefits, such as price reductions on Event fees or partner offers shown in the App. Acceptance is limited to athme and Partners listed in the App. We may change eligible items and Partners.Redemption and VAT
When you redeem coins on an eligible purchase, coins operate as a price reduction on that purchase. VAT, if applicable, is calculated on the discounted price according to applicable rules.Expiry and validity
Promotional coins may have shorter validity. We will show any expiry before use. If you buy coins with money in Denmark, they will have a minimum validity of three years unless a shorter period is clearly disclosed and permitted by law. Expired coins cannot be reactivated.No cash out and limited network
Coins cannot be redeemed for cash or used outside the App. Acceptance is limited to a defined network of goods and services. Coins do not bear interest.Abuse and errors
We may adjust balances or refuse redemption if coins were granted or used in error, obtained by fraud, or used in breach of these Terms. If we suspend or close your account for breach, unused promotional coins may be forfeited.Referral Program Abuse and Fraud Prevention
We have implemented a referral program that rewards users with athme coins for referring new participants to the platform. While we encourage you to invite others, it is strictly prohibited to abuse this system. The following actions will be considered violations of these Terms and may result in a permanent ban from the App:1. Referral Loops:
Using referral links within groups or among users who refer each other in a loop (i.e., each person refers another to earn free coins), is not allowed.2. Creating Multiple Accounts:
Creating or using multiple accounts for the purpose of generating referral rewards through fraudulent or coordinated actions is strictly forbidden. This includes using fake or duplicate accounts to attend events and claim rewards through those accounts.Any attempt to manipulate or exploit the referral system will be considered fraud and may result in the permanent suspension of your account and forfeiture of any earned coins.
Consumer rights for bought coins
If you buy coins, this is a contract for digital content. We will ask for your express consent to immediate delivery and your acknowledgment that you lose the 14-day withdrawal right once delivery starts. If you do not consent, delivery starts after the withdrawal period. Your statutory rights for lack of conformity are preserved.Promotions and changes
We may run coin promotions or multipliers and may change earn rates, redeem rates, eligible items, and expiry rules on a go forward basis. We will not reduce the remaining validity of coins you have already bought without reasonable notice.13. INTELLECTUAL PROPERTY
The App, its code, databases, functionality, software, designs, text, photographs, video, audio, graphics, and trademarks are owned by us or our licensors and are protected by law. Subject to these Terms, we grant you a limited, non exclusive, non transferable, revocable license to use the App for your personal, non commercial use. All other rights are reserved.
14. USE OF PHOTOGRAPHY AND VIDEO CONTENT
At athme Events we may capture general atmosphere photos and videos for the purpose of promoting athme. Our legal basis is legitimate interests balanced with your rights. We aim to use such materials respectfully.
For close ups, posed images, or materials used in targeted campaigns, we will obtain consent where required. You can object at the venue, or later request removal of identifiable images that we control. See the Privacy Policy for how to contact us.
If you appear in Event media, you acknowledge that such materials may be used on our website, the App, social channels, and in promotional materials without compensation, subject to data protection law.
15. USE OF PHOTOGRAPHY AND VIDEO CONTENT
You agree not to:
• use the App for unlawful or unauthorized purposes
• access or scrape the App using automated means unless allowed by us
• interfere with security features or circumvent access controls
• upload malicious code or content that disrupts the App
• impersonate another person or misrepresent your affiliation
• collect user data without consent or a lawful basis
• infringe intellectual property or privacy rights
• send unsolicited communications
• use the App to compete with us in a prohibited manner
• sell or transfer your profile
• buy, sell, exchange, transfer, or attempt to cash out athme coins outside the App.
16. ILLEGAL CONTENT NOTICES
If you believe content in the App is illegal or infringes rights, submit a notice with the URL, a description of the issue, and your contact details using the contact information in the App or on our website. We will review and act where appropriate. We may suspend or remove content or accounts that breach law or these Terms.
17. APP MANAGEMENT AND SUSPENSION
We may monitor compliance with these Terms. We may remove content, limit features, suspend, or terminate accounts for breach, suspected fraud, or risk to users, or as required by law. We may preserve information to comply with legal duties and to enforce our policies.
18. PRIVACY
We care about data privacy and security. Our processing of personal data is described in the Privacy Policy, which is incorporated by reference. The App is hosted in Denmark. By using the App you consent to processing in Denmark and, where applicable, international transfers as described in the Privacy Policy. Your rights and how to contact our data protection contact are explained there.
19. DISCLAIMER
The App and all content are provided on an as is and as available basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the App will be uninterrupted, secure, or error free.
We do not endorse or assume responsibility for any product or service advertised or offered by a third party through the App or any linked site. Use your own judgment and exercise caution.
20. LIMITATION OF LIABILITY
To the extent permitted by law, we and our directors, employees, and agents are not liable for indirect, consequential, incidental, special, punitive, or exemplary damages, including lost profit, lost revenue, or loss of data, arising from or related to your use of the App or any Event. Our total liability to you for any claim will not exceed the amount you paid to us in the six month period before the event giving rise to the claim. Certain laws do not allow exclusion of certain warranties or limitations. If those laws apply, some limitations may not apply to you.
21. INDEMNITY
You agree to defend, indemnify, and hold harmless athme ApS, its affiliates, officers, agents, partners, and employees from and against claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or related to your use of the App, your breach of these Terms, your violation of law, or your violation of third party rights.
22. ELECTRONIC COMMUNICATIONS AND SIGNATURES
You consent to receive communications electronically. You agree that electronic agreements, notices, disclosures, and other communications that we provide satisfy legal requirements that such communications be in writing. You agree to the use of electronic signatures and records.
23. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of Denmark. If your habitual residence is in the EU and you are a consumer, you also benefit from the mandatory provisions of the law of your country of residence. You and athme ApS submit to the non exclusive jurisdiction of the courts of Copenhagen. You may bring claims in Denmark or in the EU country where you reside.
24. DISPUTE RESOLUTION AND ODR
You can raise concerns directly using the contact details in the App. The European Commission provides an online dispute resolution platform athttps://ec.europa.eu/consumers/odr.
25. CHANGES TO THE APP
We may change, update, or discontinue the App at any time. We do not guarantee that the App or any content will always be available.
26. MISCELLANEOUS
These Terms and any policies or rules posted in the App constitute the entire agreement between you and us. Our failure to exercise or enforce any right is not a waiver. If any provision is unlawful, void, or unenforceable, that provision is severable and the remaining provisions remain in effect. No joint venture, partnership, employment, or agency relationship is created by your use of the App. These Terms will not be construed against us as the drafter. If these Terms are translated, the English version controls in case of conflict.
